Please read these Terms of Service ("Terms," "Terms of Service") carefully before using the ryoku-dynamics.com website (the "Site") and the SUPRA-RD Security system or any other products and services (collectively, the "Services") operated by Ryoku Dynamics ("us," "we," or "our").
Your access to and use of the Services is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Services.
By accessing or using the Services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Services.
1. License to Use SUPRA-RD Products
Grant of License: Upon purchase and successful activation, Ryoku Dynamics grants you a non-exclusive, non-transferable, revocable license to use the SUPRA-RD Security system software within the Second Life® virtual world environment, subject to these Terms and any specific license agreement accompanying the product.
License Key and Activation: Activation of the product requires a valid license key obtained through legitimate purchase. The license key is for your use as per the terms of the product (e.g., per avatar, per account, per land parcel, as specified at the time of purchase).
License Hashing: You acknowledge that the SUPRA-RD Security device generates a HASH value locally based on certain parameters for license validation. This HASH, not the raw identifiable data, is associated with your license key in our cloud service.
Restrictions: You agree not to:
- Decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code of our products.
- Modify, adapt, translate, or create derivative works based on our products.
- Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available the products or your license key to any third party, except as explicitly permitted by the product's terms (e.g., transfer of a Second Life object containing the product, if allowed by the product license).
- Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) on or in our products.
- Use the products for any illegal purpose or in violation of any local, state, national, or international law, or any terms of service of the Second Life platform.
2. Intellectual Property
The Site and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Ryoku Dynamics and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Ryoku Dynamics. The SUPRA-RD Security system and other products are protected by copyright, trademark, and other laws.
3. User Accounts (If Applicable)
If you create an account with us on our Site (e.g., for support or license management), you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
4. Website Content
The content on our Site is for general information purposes only. While we endeavor to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance you place on such information is therefore strictly at your own risk.
5. Limitation of Liability
In no event shall Ryoku Dynamics, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose. Our products are designed for use within the Second Life virtual environment. We are not responsible for the actions of other users within Second Life or for any issues arising from the Second Life platform itself. The effectiveness of security products can also depend on user configuration and the evolving nature of threats.
6. Disclaimer
Your use of the Services is at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Ryoku Dynamics its subsidiaries, affiliates, and its licensors do not warrant that a) the Services will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Services are free of viruses or other harmful components; or d) the results of using the Services will meet your requirements.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of El Salvador, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Services and supersede and replace any prior agreements we might have had between us regarding the Services.
8. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.
